1. About These Terms

These Terms of Use govern your access to and participation in The Magic Experience Awards ("the Awards"), a contest owned and administered by Foxglove Media Group LLC, a Cook Islands limited liability company ("Foxglove", "we", "us", or "our"). By accessing this website or submitting an entry, you agree to be bound by these terms.

The Magic Experience Awards is not affiliated with, endorsed by, or connected to Warner Bros., Universal Studios, J.K. Rowling, or any related entities. The contest is governed by separate Official Rules available at magicexperienceawards.com/rules.

2. Eligibility

Participation in the Awards is open to individuals worldwide who are 18 years of age or older. Employees, contractors, and immediate family members of Foxglove Media Group LLC, Wizard's Way House, and The Daily Harry Potter are not eligible to receive awards, though they may participate in voting.

Foxglove reserves the right to verify eligibility and to disqualify any participant who does not meet these requirements or who is found to have acted in bad faith.

Age Verification: By participating, you confirm that you are 18 years of age or older. The Magic Experience Awards is not directed at children under the age of 13. If you are under 13, do not submit any personal information to this site. If Foxglove becomes aware that a child under 13 has submitted personal information, it will take steps to delete that information promptly.

3. Nominations, Submissions, and Content

By submitting a nomination or any other content through this site, you represent and warrant that: (a) you are the author of, or have the right to submit, all content included in your submission; (b) your submission is truthful, based on genuine personal experience, and does not misrepresent any person, property, or event; (c) your submission does not infringe the intellectual property, privacy, publicity, or other rights of any third party; and (d) your submission does not contain defamatory, obscene, threatening, harassing, or otherwise unlawful content.

By submitting, you grant Foxglove Media Group LLC, Wizard's Way House, The Daily Harry Potter, and all current and future contest sponsors and partners a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, sublicensable licence to use, display, reproduce, distribute, modify, adapt, create derivative works from, and share your submission in any media now known or hereafter developed, for any purpose including advertising, promotion, and publicity of the contest and its sponsors.

You agree to indemnify, defend, and hold harmless Foxglove Media Group LLC, its members, officers, employees, agents, sponsors (including Wizard's Way House and The Daily Harry Potter), and partners from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your submission or participation in the Awards; (b) your breach of these Terms; (c) your violation of any third-party right; or (d) any claim that your submitted content caused damage to a third party.

Music and Copyright: Entrants are solely responsible for ensuring that all elements of their submission, including but not limited to music, soundtracks, images, and video clips, are either original or properly licensed. Submissions containing copyrighted music or other third-party intellectual property without documented permission may be disqualified at Foxglove's sole discretion. Entrants agree to indemnify and hold harmless Foxglove, its sponsors, and their agents from any copyright infringement claims arising from their submission.

Foxglove reserves the right to reject, remove, or disqualify any submission that it determines, in its sole discretion, to contain offensive, defamatory, misleading, infringing, or otherwise inappropriate content. Such removal does not limit Foxglove's right to pursue any other remedies available at law.

4. Voting Rules

Voting is limited to one vote per person per category per voting period. Any attempt to manipulate results through automated systems, multiple accounts, or coordinated inauthentic behaviour will result in disqualification of all votes associated with that activity.

Foxglove's decisions regarding vote counting, eligibility, and winners are final and binding.

5. Prizes, Recognition, and Programme Continuity

Winners will be announced publicly and may receive recognition materials as determined by Foxglove in its sole discretion. Details of any prizes, if applicable, will be communicated separately prior to the relevant voting period. No cash alternative is available unless expressly stated.

PARTICIPATION IN THE AWARDS CONFERS NO ENTITLEMENT TO ANY PRIZE, RECOGNITION, OR AWARD. Foxglove makes no guarantee that any specific prize will be offered, that the programme will complete on the timeline stated, or that the programme will not be modified, postponed, or cancelled. Foxglove reserves the right to cancel, suspend, modify, or extend any phase of the programme at any time without liability to participants.

Where any prize is offered, it is subject to its own separate terms. Prizes are non-transferable unless otherwise stated. Foxglove is not responsible for the delivery or fulfilment of any prize provided by a third-party sponsor.

6. Intellectual Property

All content on this website, including text, graphics, logos, and design, is the property of Foxglove Media Group LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

"Harry Potter" and all related names, characters, and marks are trademarks of Warner Bros. Entertainment Inc. Their use on this site is for descriptive purposes only and does not imply any affiliation or endorsement.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOXGLOVE MEDIA GROUP LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND SPONSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THIS SITE, YOUR PARTICIPATION IN THE AWARDS, OR ANY CONTENT SUBMITTED BY YOU OR THIRD PARTIES. THIS INCLUDES, WITHOUT LIMITATION, ANY ERRORS OR OMISSIONS IN CONTENT, LOSS OF DATA, INTERRUPTION OF SERVICE, NON-DELIVERY OF PRIZES, OR CANCELLATION OF THE PROGRAMME.

TO THE EXTENT THAT LIABILITY CANNOT BE EXCLUDED BY LAW, FOXGLOVE'S TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100.00) OR THE MONETARY VALUE OF ANY PRIZE ACTUALLY RECEIVED BY YOU, WHICHEVER IS GREATER.

THIS SITE AND THE AWARDS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, FOXGLOVE'S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

8. Sponsor Separation and Liability

Wizard's Way House and The Daily Harry Potter are presenting sponsors of the Awards. They are not co-organisers, co-administrators, or co-operators of the programme. All operational decisions regarding nominations, voting, judging, and prize fulfilment rest solely with Foxglove Media Group LLC.

Foxglove Media Group LLC and its sponsors are independent legal entities. Neither Wizard's Way House nor The Daily Harry Potter is responsible for any act or omission of Foxglove Media Group LLC in connection with the Awards, and Foxglove Media Group LLC is not responsible for any act or omission of either sponsor in connection with their own separate businesses, products, or services.

Any dissatisfaction or dispute relating to a stay at Wizard's Way House or any content published by The Daily Harry Potter is entirely separate from and unrelated to the Awards programme and must be raised directly with the relevant sponsor.

9. Dispute Resolution

If you have a dispute with Foxglove relating to the contest, you agree to first attempt to resolve the dispute informally by contacting us through our contact form. If the dispute is not resolved within thirty (30) days, either party may pursue binding individual arbitration administered by the American Arbitration Association in Orange County, Florida, under its Consumer Arbitration Rules.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You may bring claims in small claims court in Orange County, Florida if your claim qualifies.

10. Force Majeure

Foxglove shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, pandemic, government action, third-party platform outages (including email service providers or hosting providers), or intellectual property enforcement action requiring modification of the programme.

11. Modifications

Foxglove reserves the right to modify these Terms of Use at any time. Changes will be effective upon posting to this page. Continued use of the site constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of the State of Florida, United States of America. Any disputes arising shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, Florida, except where prohibited by local law.

13. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Foxglove's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Entire Agreement: These Terms, together with the Privacy Policy and Trademark & Affiliation Disclaimer, constitute the entire agreement between you and Foxglove regarding the Awards and supersede any prior understandings or agreements.
